        At Sharp-Photography we understand that the unforeseeable does happen, we will do our best to accommodate changes where possible but in order to protect our        

customers we have written our terms and conditions, with this is mind.          

 

We can only perform the standard of photography that you expect from us with suitable and adequate cooperation from you the client, failure to adhere to this could result in

        sub-standard results of your final images. While we will always do our utmost  to provide you with the highest standard and quality possible, you also play a big part in the final results

 

1)    Contracts      

       Contracts between the Customer and Sharp-Photography are formed upon Sharp-Photography's written acceptance or execution of Customer's Invoice and shall be subject to this           Agreement.  

 

2)    Liability & Damages

a)    The Photographer shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit.                 Where work is defective for any reason,  including negligence, the photographer’s liability (if any) shall be limited to rectifying such defect.

       Personal Accident Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held         responsible for any personal accidents during a photographic shoot.

b)   The Clients shall be responsible for any; damages undue wear or breakages to Sharp Photography's equipment, any incidents occurring during the event shall result in notification to             the client within 24 hours and invoicing directly to the Client for which payment is due upon receipt, failure to do so will incur and not be limited to court action and settlement.

 

3)    Terms of payment  

a)    Payment of the non-refundable booking fee is required within 3 working days of booking being accepted by the Company

b)    50% of the total invoice is required no less than 180 days before the date of the event. This is to ensure you have covered the costs required for us to attend and work at your                        wedding.

c)    The total invoice amount, not including the deposit, is due no less than 7 days before the date of the event.  In the case of late booking an invoice will be sent from Sharp-                                Photography to the customer with details of required payment date.      

 

4)    Cancellation  

a)    In the highly unlikely event of cancellation by all photographers or unavoidable total photographic failure, the photographers’ liability shall be limited to a full refund of any booking fees          and fees paid. Re-shoots may be arranged if practicable but the photographers will not be responsible for any further costs.

b)    On location shoots cancelled due to adverse weather conditions will be re-booked at a mutually acceptable time for both parties. A refund of fees paid (not including booking fee) will         be made if the customer does not  wish to re-book the shoot.

c)    The photographers will endeavor to appoint other photographers in the unlikely event that they are unable to attend a booking. However it may prove difficult or impossible to find a             skilled replacement photographer at short notice or at the same price.

d)    If the Clients should have to cancel a booking the following cancellation fees will become due immediately:

I.     If written cancellation of booking is received no less than 180 days before the original date of the event, the amount outstanding from the original invoice is no longer payable.

       The non- refundable booking fee and any payments made will be retained by Sharp-Photography.

II.    If written cancellation of booking is received no less than 7 days before the event, the non-refundable booking fee and 75% of the invoice amount is due to Sharp-Photography.

III.   If the booking is cancelled within the final 7 days before the event, the non-refundable booking fee and 100% of the invoice amount is retained by Sharp-Photography.

IV.  In the event of postponement, then at the discretion of Sharp-Photography, and subject to availability, monies other than the booking fee may be applied to the new wedding date.

V.   If a cancellation is made within 6 months before the event date, all payments made to Sharp Photography will be retained up to 75% of the total invoice amount.

VI.  It is essential to inform the photographers as soon as possible of any changes of venue, times, or contact details etc.

5)   COVID-19
a)    If you request Sharp Photography to postpone and re-schedule your wedding date due to COVID-19, Sharp Photography will work with you to arrange a suitable date. If this

        is arranged amicably, then no costs will be incurred and we will also transfer your booking over.

b)    If you require to re-arrange your wedding date more than once an admin charge of 50% of your original booking fee will be needed to cover ongoing costs.  

c)    If you decide to cancel your wedding after postponement of your original date, then all booking fees and any payments made to Sharp Photography are retained by

        Sharp Photography. 

 

6)   Image Rights and After Care

a)   Sharp Photography offer LifeTime storage of all images. This is a free service and has no monetary value in the unlikely event should the service fail. You are responsible for the safety           and storage of your own copies of all media supplied to you by Sharp Photography. You should not rely solely on the LifeTime storage offer by Sharp Photography and should also take         precautions to safeguard your data.

b)   All Images taken by Sharp Photography remain property of Sharp Photography’ The data/files that are supplied to you the client are copies for your personal use, to be used as                       indicated by Sharp Photography at the time of collection. Failure to adhere to these terms will result in the forfeit of your aftercare, storage and follow on work.

c)   Sharp Photography reserve the right to use any images they chose on the business website to promote services offered by Sharp Photography.

d)   Sharp Photography will not post images or use images on social media sites without first asking clients permission.

e)   The importance in complying with terms 6a & 6b will ensure maximum safeguard of your data on the Internet. Failure to adhere to these will result in this service being taken out of               the  control of Sharp Photography.
